At Stella Orange, Wordsmith LLC (“Stella Orange”), we respect and are committed to the protection of user privacy. By using the Stella Orange website (Site), you are agreeing to be bound by our Site Terms of Use, including this policy. If there are any terms in this policy that you do not agree with, please discontinue using our Site and our products and services.

1. What we collect and how we collect it

The personal information we collect about you depends on the dealings you have with us. “personal information” includes information about an individual who is reasonably identifiable. For example, if you:

(a) register on the Site, you may be asked to complete a registration form and provide personal information. You may also be asked to choose a user ID and password in order to take advantage of certain features on the Site or digital messaging services, such as newsletters or contests. Your decision to register is voluntary and you will have the opportunity to decide whether or not to disclose information to us and what communications you would like to receive; however, please note that products and services available on the Site may require registration and if you elect not to provide such information, you will not be able to take advantage of those products and services;

(b) provide details to join special mailing lists or databases if you’d like to receive information about, for example, certain products, we may collect your name, contact details, and information about your shopping or product preferences;

(c) make a purchase online or set up an online account, we will collect your name, contact details, order details, credit card details, address and we may also ask you to provide your date of birth;

(d) provide information via social media pages such as providing your name or contact details via the Stella Orange Facebook page, or our Twitter or Instagram accounts or other social media sites or apps;

(e) attend a Stella Orange function or event, we will collect your name, contact details and any dietary or accessibility requirements;

(f) enter a contest, in online or printed format, we may collect your name and contact details along with your merchandise, service preferences, and answers. Participation is voluntary, and you will have the opportunity to decide whether or not to disclose information to us. Your personally identifiable information may be used to contact you for winner notification, prize delivery confirmation or other related purposes (see the rules of each contest for details about how your personal information will be used, including postings to the Site);

(g) participate in surveys or games, you may have to register and we may request personally identifiable information from you in conjunction with the survey or game. Participation is voluntary, and you will have the opportunity to decide whether or not to disclose information to the Site;

(h) send us an inquiry or provide us with feedback, through our online form or via email or phone, we will collect your name, contact details, details of your inquiry or feedback and information about our response.

(i) apply for a job with us, we will collect the information you include in your job application, including your and your referee’s contact details;

(j) engage with or purchase products from third parties who deal with us;

(k) carry out assessment and analysis (for example market, customer and product analysis) to enable us to review, develop and improve the products or services which we offer; and

We may also collect information that cannot be used to directly identify you, such as browser type, Dynamic Internet Protocol (IP) address, “click stream” data, and similar non-personally identifiable information. For example, we may aggregate non-personal information about you and other customers who visit certain areas of our Site. Aggregated information will not contain any information that can be linked directly back to you.

You agree that you do not object to us using your personal information for any of the purposes outlined in this policy and you confirm that you do not and will not consider any of these purposes as a breach of any of your rights under applicable privacy laws.

Information is automatically collected through your use of the Site and/or affiliates’ websites through cookies. Cookies are tiny text files that websites or apps may place on your computer or device.

3. Why we collect personal information

Main purposes

The main purposes for which we may, from time to time, collect, hold, use and disclose personal information are:

(a) to facilitate account creation and the logon process;

(b) to send administrative information to you related to your account, and/or for legal reasons;

(c) to request feedback;

(d) processing transactions online, and delivering products and services;

(e) to provide any associated loyalty program;

(f) promoting us and our products and services, including through direct marketing, events and competitions, public relations and social media;

(g) performing research and statistical analysis, including for customer satisfaction and product and service improvement purposes. Direct marketing and opting out

With your permission and by providing your address, email address and telephone numbers to us we may contact you for the purposes set out above.

If you do not wish us to hold your personal information or you do not wish to receive information from us then there are a number of ways you can unsubscribe:

(a) noting your preferences at the time you register your account with the Site;

(b) logging in to your account settings and updating your preferences (if applicable);

(d) using the unsubscribe link that we include in our emails to opt out of receiving those messages. Each “unsubscribe” link might only relate to that specific type of communication (e.g. marketing communications or survey communications). This means that unsubscribing from marketing communications will not automatically unsubscribe you from our survey communications (or vice versa). Please also note that (i) you may continue to receive communications which are already en route to you for a short period of time while your relevant unsubscribe request is being processed; and (ii) we may still need to send you service related emails that are necessary for the administration and use of your account.

4. Who we may share your personal information with

We will not share your personal information without your consent except with third parties where appropriate for the purposes set out above, including:

(a) financial institutions for payment processing; and

(b) our contracted service providers or partners, including: overseas and local agents; delivery and shipping providers; information technology service providers; venues and event organizers; marketing and communications agencies; research and statistical analysis providers; call centers; hard copy and electronic mail houses; manufacturers and suppliers; external business advisers (such as recruitment advisors, auditors and lawyers); and regulatory, investigative or government bodies to comply with laws.

We may also disclose your personal information as is necessary to: (a) comply with a subpoena or court order; (b) cooperate with law enforcement or other government agency; (c) establish or exercise our legal rights; (d) protect the property or safety of our company and employees, contractors, vendors, and suppliers; (e) defend against legal claims; (f) help with internal and external investigations; or (g) as otherwise required by law or permitted by law.

5. Data quality and security

General

We hold personal information in a number of ways, including in printed documents, electronic databases and email contact lists. Printed documents may be held at our office, or archived in boxes and stored in secure offsite facilities. We take reasonable steps to:

(a) ensure that the personal information that we collect, use and disclose is accurate, up to date and complete and (in the case of use and disclosure) relevant;

(b) protect the personal information that we hold from misuse, interference and loss and from unauthorized access, modification or disclosure; and

(c) destroy or permanently de-identify personal information that is no longer needed or that you have requested that we delete.

You can help us keep your information up to date, by letting us know about changes to your details.

Security

The steps we take to secure personal information include website protection measures, security restrictions on access to our computer systems, controlled access to our business premises, policies on document storage and security, personnel security and training and workplace policies. While we endeavor to protect the personal information of users of our Site, we cannot guarantee the security of information you disclose online: you disclose that information at your own risk. If you are concerned about sending your information over the internet, you can contact us as set out in section 10. You can also help protect your personal information by keeping your account details confidential. If you become aware of any security breach, please let us know as soon as possible.

The Site may make chat rooms, forums, commenting and message boards available to you and other users. You are not required to provide any personal information when using these areas but you may choose to do so. If you post personal information online, it will be publicly available and you may receive unsolicited messages from other parties.

We cannot ensure the security of any information you choose to make public in a chat room, forum, or message board. Also, we cannot ensure that parties who have access to such publicly available information will respect your privacy. Please exercise caution when deciding to disclose personal information in these areas. In some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why.

Third party sites

Links to third party sites that are not operated or controlled by us are provided for your convenience only and should be used with your discretion and prudent judgment. Some of these third-party marketing channels may be “co-branded” with our logo; even so, these third-party channels are not operated, controlled or maintained by us. We are not responsible for the privacy or security practices of those sites, which are not covered by this policy. Third party websites should have their own privacy and security policies, which we encourage you to read before supplying any personal information to them. Links from our Site to third-party sites do not constitute sponsorship, endorsement, or approval of the content, policies or practices of such third-party sites.

Online Payments

Our credit and debit payment processing is currently accomplished through PayPal, a third party processing service that allows us to accept your payment online.

Your data may be stored on PayPal’s application.

Payment

If you choose a direct payment gateway to complete your purchase, then PayPal stores your credit card data. According to our best information, your data is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data should be stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information should be deleted.

All direct payment gateways are required to adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express, and Discover.

PCI-DSS requirements help ensure the security handling of credit card information by the Site and its service providers.

6. Access and correction

General

Please contact us if you would like to access or correct the personal information that we hold about you. We may ask you to verify your identity before processing any access or correction requests, to make sure that the personal information we hold is properly protected.

Access

We will generally provide you with access to your personal information within 30 days, subject to some exceptions permitted by law. We will also generally provide access in the manner that you have requested (eg. by providing photocopies or allowing a file to be viewed), provided it is reasonable and practical for us to do so. We may however charge a fee to cover our reasonable costs of locating the information and providing it to you.

Correction

If you ask us to correct personal information that we hold about you, or if we are satisfied that the personal information we hold is inaccurate, out of date, incomplete, irrelevant or misleading, we will take reasonable steps to correct that information to ensure that, having regard to the purpose for which it is held, the information is accurate, up-to-date, complete, relevant and not misleading. If we correct personal information about you, and we have previously disclosed that information to another agency or organization, you may ask us to notify that other entity. If so, we will take reasonable steps to do so, unless this would be impractical or unlawful.

7. Cross Border Disclosure Access and Consent to Transfer

We may disclose personal information to overseas recipients, who are located in places such as Japan, Singapore, India, Hong Kong, the Philippines, Canada and other countries or jurisdictions depending on the nature of the services those recipients provide to us (for example storing data via a cloud service, or where our customer relationship management system is hosted on servers located overseas, or where delivery address information for online orders is managed via a third party located overseas).

By providing us with your personal information, you consent to our use of it in accordance with this policy, including the transfer of your information across international boundaries to jurisdictions anywhere in the world as permitted by local law.

For United States Users:

The United States may not have data privacy laws that are deemed to afford an equal level of protection for your Personal Information as those laws legislated at the direction of the European Union or geopolitical, national or regional legislative bodies. However, please be assured that we will continue to adhere to the principles stated in this policy and will make reasonable efforts to comply with applicable international, national, regional, territorial, and provincial laws in connection with any information collected through the Site. We will always endeavor to preserve the integrity, confidentiality, and security of personal information and afford such personal information reasonable level of protection.

Your California Privacy Rights: Other than as is stated by this policy, we will not share any personal information about you with outside third parties for their direct marketing purposes to the extent prohibited by California law, unless you agree otherwise as authorized by your prior written consent.

We do not track you over time and across third party websites to provide targeted advertising and our Site does not respond to Do Not Track (DNT) signals. However, some third party sites do keep track of your browsing activities when they serve you content, which enables them to tailor what they present to you. If you are visiting such sites, your computer operating system (eg. Safari) allows you to set the DNT signal on your browser so that third parties (particularly advertisers) know you do not want to be tracked. Third parties that have content embedded on our website may set cookies on a user’s browser and/or obtain information about the fact that the web browser visited this website from a certain IP address. Third parties cannot collect any other personal information from our website unless you provide it to them directly.

California Civil Code Section 1798.83, also known as the “Shine the Light” Law, gives California residents the right to request information from us regarding the manner in which we may share personal information with affiliated companies and third parties for their direct marketing purposes. 3. examples of the products and services subject to the third-parties’ direct marketing programs, if the nature of the third parties’ business cannot be determined from their names.

8. Data Retention Periods

We will retain your personally identifiable information for as long as your account is active or as needed to provide you with our products and services. If you wish to cancel your account or request that we no longer use your information to provide you with our products and services, please contact us at concierge@stellaorange.com and we will remove your personal information from our systems. However, we will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

9. General Audience Website Not Directed Toward Children

Protecting the online privacy of children is especially important to us. The Site is a general audience site. Our content is neither directed toward minors nor children who are under the age of 13. We do not knowingly collect personal information from children under the age of 13. If you are under 18 years old, please do not provide us with your name, contact details or any other information about yourself.

If we, or our internet service provider, become aware that a minor or a child under the age of 13 has provided us with personal information without the parental consent, that information will be deleted from our systems. By accessing this Site, you agree that the laws of the State of Florida apply to this Site, the Site’s Terms of Use (including this privacy policy) and all matters arising under them.

12. Changes to this Policy

We may amend this policy from time to time. Please check back frequently to see any updates or changes. If we make a material change to the way in which we collect, use, and/or share your personal information, we will post a notice on the Site and/or send an email to users who have provided an email address.
